Adnan Syed, a Baltimore resident whose alleged involvement in the 1999 murder of 17-year-old Hae Min Lee was the subject of the popular podcast Serial, has had his murder conviction upheld by a court in Maryland.

Syed, 41, was found guilty of killing Lee in 2000 and given a life sentence, while continuously claiming his innocence. State prosecutors announced in September of last year that they had found fresh information that cast doubt on Syed’s conviction and suggested two additional suspects.

Then, a circuit court judge overturned Syed’s conviction after finding that the prosecution had neglected to share any favourable evidence with the defence. The case was not recharged by the prosecution, who instead entered a “nolle prosequi” in the court file. Hae Min’s brother Young Lee filed an appeal in December, claiming that prosecutors had broken the law by failing to provide victims or their representative’s adequate notice of sessions so they could attend in person.

The Maryland appeals court ruled on Tuesday that the state had violated Lee’s rights by providing him with only one business day’s notice and that the court “has the power and obligation to remedy those violations, so long as we can do so without violating Mr Syed’s right to be free from double jeopardy.”But, the judgement also implies that Syed won’t be convicted for very long and that the rehabilitation would only last until the hearing is redone.

The decision mandates “a new, legally correct, and open hearing on the motion to vacate, where Mr. Lee is given notice of the hearing adequate to enable him to attend in person, where evidence in support of the motion to vacate is presented, and where the The court justifies its choice by giving its reasoning. ” After being let out of prison, Syed now works on prison reform at Georgetown University’s Prisons and Justice Institute.
