On the broadcast of CNN This Morning airing on Thursday, Moss made an appearance to discuss the network’s allegations that federal prosecutors have a recording of Trump discussing a top-secret Pentagon document he was in possession of. Apparently contradicting both his denials of any wrongdoing and his boast that he can declassify data with just a thought, Trump reportedly stated that he no longer had the ability to declassify the document.
In his appraisal of the case, Moss stressed that it speaks volumes about Trump’s objectives that he was aware that the files were classified and that distributing them was forbidden.
“This underlies and undercuts the potential defense issue that he was going to raise of he had automatically declassified it or he didn’t know,” said Moss. “No. He was definitely aware, and that suggests that he purposefully kept up with developments in national defenses. The espionage clause is present there.
Moss said the former president “has a slight bit of truth in his statements” on his capacity to declassify while in office when asked what the components of an Espionage Act accusation against Trump would be. Trump’s team hasn’t been able to prove that the declassification was done the right way, though.
Moss then poked fun at Trump’s legal team for trying to defend him in court even though doing so would place them in violation of the law. Hincapie now resides in Florida with his family and two kids, according to his lawyer Gabriel Harvis. Harvis claimed that because it took so long to prove his innocence, he was the case’s final victim.
