Evan Corcoran, a lawyer for Donald Trump, was spotted Thursday entering the federal courthouse in Washington, D.C., where grand jury issues are resolved. According to all accounts, he was there to rebut Trump’s assertions of executive privilege once more, this time in relation to the former vice president Mike Pence’s testimony in the special counsel’s probe on January 6.
On Friday, Corcoran was once more spotted approaching that same courthouse, but this time, he was anticipated to be wearing a very different hat: he would be testifying before a grand jury as part of the special counsel’s inquiry into Mar-A-Lago records.
Although Corcoran has been a lawyer for Trump since April 2022, when the Justice Department started looking into possible records-related violations, he is most known for writing a June 3 certification that declared all sensitive documents at Mar-a-Lago had been handed over to federal authorities. That claim was demonstrably inaccurate when the FBI’s search in August of last year turned up more than 100 additional classified papers.
Early in January, Corcoran testified before the grand jury, but he chose not to respond to some queries because of the attorney-client privilege. The “crime-fraud exception,” which states that the attorney-client privilege does not apply when a client uses a lawyer, with or without that lawyer’s knowledge, to further a crime or fraud, was requested by special counsel Jack Smith in early February by then-Chief Judge Beryl Howell of the U.S. District Court for the District of Columbia.
Yet, I have a sense that Trump’s staff authorized Corcoran’s testimony to take place because of the evidence, which is probably involved in any request to postpone, much less review, a crime-fraud-related finding. To put it another way, the justices would have seen some, if not all, of the evidence that Trump misled Corcoran and committed crimes if he had asked the Supreme Court to halt Corcoran’s testimony and the production of documents. This is because Judge Howell and the three-judge panel on the D.C. Circuit have already reviewed this evidence.
