According to a report from the BBC on Monday, the British government might be sued over the issue of whether leaving the European Union would inevitably result in exiting the single market.

In order to remove the decision from the government’s control, the pro-EU think tank British Influence will inform Brexit Secretary David Davis that it will pursue a judicial review. This will allow parliament to vote on the country’s membership in the European Economic Area (EEA).

The EEA, which permits the tariff-free movement of goods, services, capital, and labour, includes all EU member states. The government asserts that if it leaves the EU, the EEA will follow suit, but British Influence counters that it must first activate Article 127 of the EEA agreement, which calls for parliamentarian consent.

According to Jonathan Lis, deputy director of British Influence, “there is a strong possibility that the UK will be acting unlawfully by taking us out of the EEA with Brexit… so we are going to be petitioning for a judicial review.”

“Given that Article 127 provides an express procedure for withdrawal, it automatically prohibits other implied methods of withdrawal, such as ceasing to be a member of the EU,” said attorney Jolyon Maugham.

Dominic Raab, a Brexit supporter and Conservative MP, charged that the attorneys were “inventing new legal wheezes to try and frustrate the will of the people.” The public has spoken; we should respect the outcome and go forward rather than try to erect more barriers that threaten the democratic process.

After the High Court determined the government must get parliamentary approval before invoking Article 50 of the Lisbon Treaty, which gives notice of its decision to leave the EU, the government is already engaged in another legal struggle regarding Brexit. Next Monday, the government appeal will be heard by the British Supreme Court.
